years after his death, the case of oscar grant was back in court this morning. ktvu's brian flores joins us live from outside of the courthouse in san francisco to explain what was at stake. good afternoon, brian. >> reporter: hey, good afternoon, tori. well, what was at stake today was a civil case. but there was no decision made today here inside san francisco federal court. on the case of johannes mehserle and other officers involved in the shooting of oscar grant during a new year's party a few years ago. now, attorneys for anthony p. eroni and johannes mehserle argued they should be offered immunity because they argued the shooting was an accident. they also say it was tragic but there was reasonable actions by the officers to act the way they did. meanwhile, the attorneys for the victims and four others claim it was not an accident, that they were defenseless and should not be granted qualified immunity of the law. here's what both sides had to say. >> what it means is the simple fact that our rights have been violated. those young men are tie to us as a family -- are tied to us as
's no date set for the next public protection committee hearing yet. live in oakland, allie rasmus, ktvu channel 2 news. >> thank you, alley. >>> this morning, a young man in oakland was hospitalized in serious condition after he had been shot several times. the shooting took place just after 9:00 a.m. at east 31st street and 13th avenue. that's one block from highland hospital. police say the victim was shot multiple times and a witness told us it looked like he was injured in the leg e says someone drove the injured plan to the hospital and that he saw what was likely the gunman running from the scene. police say they have not yet determined a motive for the shooting. >>> a man is under arrest in connection with the kidnapping and assault of a 16-year-old autistic girl from oakland. she was taken last tuesday after leaving the fred finch youth center in oakland. staff members say they followed her for several blocks to the fruitvale b.a.r.t. station where they lost site of her. she was found two days later on a muni bus in san francisco. family members say she was badly beaten and sexu
in san jose. police are investigating a fatal stabbing. ktvu janine de la vega is on the scene and tells us what police say they have led up to the violence. good morning, janine. >> reporter: good morning, tori. in the last half hour homicide investigators arrived here on the scene. right now they are on the backside of the building. starting to collect evidence. what we do know is that the stabbing happened while a party was going on at one of the businesses that you see right there. it's called the agency. just after 3:00 this morning police were called to the photography business on oakland road. officers say a party with about 30 minute was going when a fight broke out and a man got somebodied in his stomach. he was rushed to the hospital where he died shortly there after. >> we got several witnesses that are taking the police officer. >> musers says that were sever witness that left the scene while they arrived. one guest told us it was a graduation party. officers say the man who died was in his 30s. his identity is not been released yet. officers when we spoke with them, they wer
starlets to pick up. ktvu allie rasmus live at sfo to tell us what is happening out there and what is expected to be one of the busiest days of the holiday season. >> reporter: that rainy weather could have an impact on your travel plans if you're flying in and out of sfo. so far so good. we checked and there are no cancellations or delays to report. it is really busy out here though. if you take a look behind us you can see the taxis and cars and shuttles lining up along the curb here unloading passengers as they prepare to check in for their flight. this is the peak travel day of the holiday season with 130,000 people expected to pass through sfo. an estimated two million people are expected to come through between now and january 6th. inside the terminal we kept monitoring the board. we've been here since 3:30 this morning. we keep checking and there have been no delays or cancellations in and out of sfo. everything is leaving on time. and no delayed arrivals either. a couple flights from the east coast are scheduled to arrive 10-15 minutes early. all of this could change later
. nothing is happening as we can see right now. we do have ktvu's pline grow res there. he will bring us a live update from the ground coming up at 7:30. >>> a round of rain and strong wind moving into the bay area could affect your holiday travel plans. allie rasmus just spoke to sfo officials and she joins us live from sfo with some new information about flight delays. good morning, alley. >> reporter: good morning. you can see it's not raining right now. the weather is having an effect on travel here at san francisco international airport. if you look behind us, you can see a number of people unloading. this is supposed to be the busiest travel day of the year with over 100,000 people through sfo. but because of the low ceiling and visibility, the traffic management program is in effect from sfo. this is inside the terminal. there are a lot of people here. the security line was packed. it could get more problematic and hectic today. starting at 7:00, this airport won't be able to use all of the runways because of that traffic management program put into effect by the faa. that could m

're live in green brain -- greenbrae this morning, alex savidge, ktvu channel 2 news. >> thank you, alex. >>> rising creek waters flooded roadways an temporarily closed highway 101. it happened on the peninsula in a creek that overflowed its banks. janine de la vega is live at the creek to show us some of the damage. >> reporter: well, we're right here on the border of palo alto and east palo alto. this is highway 101 and the creek flows right underneath it and the water was so high last night that it was flashing up over and onto the freeway. this is video of that same area of what it looked like last night. water was flooding on 101, north of the embarcadero. the highway patrol was helping motorists with traffic breaks. the creek crested at university avenue and woodland. the water spilled over and into the entrance of the four seasons hotel. fire officials say even though there was not massive damage, they remain worried about the creek. >> we need to work on these holes in this levy. can't leave it like this especially since we're early in the winter and this is the second significan

to have an update later. janine de la vega, ktvu channel 2 news. >>> police are looking for a young man who stabbed a 74-year- old man in downtown gilroy near lewis and monterey streets near the gilroy public library. police say the victim was stabbed in the torso but is expected to survive. his attacker is white, in his 20s with blond hair wearing dirty, tan-colored clothing. >>> police investigating bullying at an amendmentary school apparently made girl think about suicide. the parents found a suicide note m her bedroom. they claim two boys had been harassing their daughter with lewd comments. the parents called vallejo police and an investigation has begun. >>> san francisco city college may have a new financial crisis. >>> lorraine blanco is live with new information on what may be threatening funding for the school. >> reporter: we talked with veteran. and the college needs to enroll 34,000 students to keep the funding. last year, the school enrolled 32,600 students and it was put on probation. administrators expect to fall thousands short this school year. it's the second year in

we are live in sunnyvale, ktvu, channel 2 news. >>> they are investigating a fatal shooting near the square. it happened yesterday afternoon near third and franklin streets. they found the man lying in the street. he died a short time later. officers say several people were in the area at the time and may have witnessed the shooting. >> well, we were parking and we heard some, it sounded like a firecracker going off. i was saying, whoa, i was thinking the noise we heard could have been gunshots. >> police say they have not made any arrests, it is the third shooting in oakland in a 24 hour peer. >>> zack san jose police stay a boy was stabbed during the christmas celebration. the event was in full swing. the teenager was stabbed in the chest and arm and his injuries are not life-threatening. they think three people ran from the scene and police are still searching for them. >>> new, this morning, at the stroke of midnight same sex couples started lining up for licenses when washington's law allowing gay marriage went into effect. they require a three day waiting period. so today i

are driving on roads through the storm. ktvu channel 2 news. >> there are also problems in the late -- in the north bay. folks waking up due to power outages. new video shot earlier this morning. numerous trees and power lines down. sonoma county could receive up to 4 inches of rain today. the russian river is expected to flood tomorrow morning. people haven't been filling us to invade. certainly, plenty of chatter amongst the folks about potential flooding. many people are choosing to wait to see what happens with the river today. >> everybody's talking about it. this is minor compared to how it has been. >> in 1986, the russian river rose to 49.5 feet, more than 17 feet above flood level. you will get as high as 32 and a half feet tomorrow. flood stage is 32 feet. >> volunteers of the salvation army bell ringers covering after a freak mall accident. a large chunk of sheet rock from the ceiling entrance fell on top of her. it happened outside jcpenney. the woman was taken to the hospital that should be okay. investigators are trying to determine if heavy rainfall caused the damage.
